Terms of Use:

 

This website is owned and operated by Unified Pilates. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors information on the services we provide. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Bookings and Pricing

When booking a paid or free service, you agree that: (i) you are responsible for reading the requirements listing before making a commitment to book it: (ii) you enter into a legally binding contract to purchase a service when you commit to buy a service and you complete the check-out payment process. The prices we charge for using our services are provided on your booking screen. We reserve the right to change our prices for services displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page. The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your payment method and in agreement to the terms and conditions of the service selected.  

 

Class & Refund policy:

Membership Subscriptions are rolling, recurring monthly or weekly payments that can be cancelled at any time following the minimum 12 weeks term of membership. The client must email Unified Pilates to request termination of their membership. A 4 hour cancellation and rescheduling policy applies to all our Services. To cancel or reschedule, clients are required to use the booking system or link provided in their confirmation email. Classes can be booked and scheduled 14 days in advance and up to one hour prior to the class commencing. Only classes with free spaces will appear on the booking calendar. We recommend booking your classes in advance to avoid disappointment. 

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason. Membership fees may be increased by Unified Pilates at any time and the client will be given no less than 30 days notice. Unified Pilates reserves the right to change an Instructor on a class in certain circumstances, such as Illness or cancel and credit a class where this cannot be avoided. 

We operate a no-refund policy. Members may request to freeze their membership for one to three months per calendar year. The minimum period is one month. We require two weeks notice to enable a freeze on your subscription. The member must request a freeze by email stating the dates they wish their subscription to be frozen for, for example. 10th of March to 10th of April. This will result in their membership payment and subscribed services, which ordinarily fall due in this billing cycle to be suspended. Membership payments and Services will automatically recommence following the freeze period requested. 

Ownership of intellectual property, copyrights and logos.

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Unified Pilates. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Right to suspend or cancel member account.

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

General Statement of Programme Objectives and Procedures:

I understand that a physical fitness programme includes exercises to build the cardiorespiratory system (heart and lungs), the musculoskeletal system (muscle endurance and strength, and flexibility), with an increase in weight of muscle and bone. Exercise may include aerobic activities (walking and other aerobic activities), calisthenic exercises, core and other full body strengthening exercises and weight lifting to improve muscular strength and endurance and flexibility exercises to improve joint range of motion.

Description of Potential Risks:

I understand that the reaction of the heart, lung and blood vessel system to exercise cannot always be predicted with accuracy. I know there is a risk of certain abnormal changes occurring during or following exercise, which may include abnormalities of blood pressure, heart attack, stroke and even death. Use of the weight lifting equipment and engaging in heavy body calisthenics may lead to musculoskeletal strains, pain and injury if adequate warm-up, gradual progression, and safety procedures are not followed.

I understand that Unified Pilates shall not be liable for any damages arising from personal injuries sustained by a client while and during the fitness programme. The client using the exercising equipment during the fitness programme does so at his/her own risk. The client assumes full responsibility for any injuries or damages that may occur during the training.

I hereby fully and forever release and discharge Unified Pilates from all claims, demands, damages, rights of action, present and future therein. I understand and warrant, release and agree that I am in good physical condition, that I have no disability, impairment or ailment preventing me engaging in exercise (other than those items fully discussed on Health Intake form).

I state that I am at least 6 weeks postnatal and have had a recent physical check up and have my doctor’s permission to engage in aerobic and/or anaerobic conditioning.

Description of Unified Pilates Benefits:

I understand that a programme of regular exercise for the heart, lungs, muscles, joints, has many benefits associated with it. These may include an improvement in blood fats and blood pressure, and decrease in heart disease. There may also be physiological benefits.

I understand that I am expected to follow the instructor’s instructions with regard to exercise.  If I am taking prescribed medications I have already informed Unified Pilates and further agree to inform my Instructor promptly of any changes which my doctor or I have made with regard to the use of any medications or change in any medical status.  I have been informed that during my participation in the Classes I will be asked to complete the physical activities unless symptoms of fatigue, shortness of breath, chest discomfort or similar occurrences appear. At that point I have been advised that it is my complete responsibility to stop exercising and that it is my obligation to inform the instructor of my symptoms. I hereby state that I have been advised and agree to inform the instructor of my symptoms should any develop. I understand that during the performance of the exercise, physical touching and positioning of the body by the teacher may be necessary to assess my muscular and bodily reactions to specific exercise, as well as ensure that I am using the proper technique and body alignment. I expressly consent to the physical contact for the stated reasons above. I further understand that I may be instructed by the instructor to use my own physical touch for the purpose of positioning of the body during class where the class is conducted in a virtual setting. 

 

I have been given the opportunity to ask questions regarding the Courses and Private Sessions conducted by Unified Pilates and its affiliates and I have received satisfactory answers to those questions. I have submitted a comprehensive Health Intake Form and answered all required questions truthfully. I agree that Unified Pilates shall not be liable or responsible for any injuries to me resulting from my participation. I expressly release and discharge Unified Pilates, its owners, employees, agents and/or administrators from any claims, suits as a result of any injury or other damage which may occur in connection with the participation in the Courses, Classes and Private Sessions, excepting only an injury caused by the gross negligence or intentional act of such person or persons. The release shall be binding upon my heirs, executors, administrators and assigns. I have read the foregoing information and understand it. Any questions that may have occurred to me have been answered to my satisfaction.

 

Limitation of liability
To the maximum extent permitted by applicable law, the owner of Unified Pilates and its affiliates assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional Emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
